Terms and Conditions (T&C)

 

1. Scope of Application
These Terms and Conditions (T&C) apply to all services and products offered on the website, including mixing and mastering services as well as the sale of beats. By using this website and the services offered through it, the customer agrees to these T&C.

 

 

2. Mixing and Mastering Services

 

2.1 Booking and Payment
The customer must book and pay for the mixing or mastering service in advance through the website. Payment is made using the payment methods offered on the website. After successful booking, the customer is required to provide the unprocessed stems of the song via the file upload on the website or by providing their own link.

2.2 Customer's Track Requirements

To ensure optimal processing, the tracks submitted by the customer must meet the following requirements:

  • Format: Tracks must be submitted in WAV or AIFF format with a minimum resolution of 16-bit and a sample rate of at least 44.1 kHz.

  • Export Settings: All tracks must be exported uncompressed and without effects such as EQ, reverb, delay, or limiter, unless these are part of the desired sound design. Volume adjustments should also be avoided.

  • Synchronization: All tracks must have the same starting point (0:00) to ensure synchronization.

  • File Naming: Files should be clearly and accurately named to avoid confusion (e.g., "MainVocal.wav", "Beat.wav").

  • Volume Levels: Tracks should have at least -6 dB of headroom to avoid distortion and clipping.

Compliance with these requirements ensures that the mixing and mastering process runs smoothly and with the highest quality. Tracks that do not meet these requirements may lead to delays or additional processing fees.

 

2.3 Scope of Service and Turnaround Time
When booking, the customer can specify the desired turnaround time and the number of stems (individual tracks) to be processed. The processing of the song will take place within the agreed timeframe, though deviations may occur due to unforeseen circumstances.

 

2.4 Revision Policy
One free revision is included for each submitted song. The customer must submit any revision requests within 7 business days of receiving the finished song. After this period or for additional revisions, the customer must book further revisions for a fee through the website.

 

2.5 File Formats
After the mixing or mastering process is completed, the processed song will be made available to the customer as a WAVE and MP3 file via a download link.


 

3. Sale of Beats
 

3.1 Subject of the Contract

Beats are offered for sale on the website. These beats will be sold under specific licensing terms. The customer can choose between a Premium License or an Exclusive License as detailed in these T&C. Once a beat is sold under an Exclusive License, it will no longer be available for purchase on the website. However, any licenses purchased prior to the exclusive sale remain valid.
 

3.2 Preview and Purchase Process

The customer can preview the beats on the website before purchasing. To purchase, the beat is added to the shopping cart and paid for using the offered payment methods. Since the product is digital, exchanges are excluded.
 

3.3 Usage Rights

The customer acquires usage rights according to the license type purchased:

 

Premium License:

  • 100,000 Online Audio Streams

  • For Profit Live Performances

  • Distribute up to 10,000 copies

  • Unlimited music videos

  • Unlimited radio broadcasting rights

 

Exclusive License:

  • UNLIMITED Online Audio Streams

  • For Profit Live Performances

  • Distribute UNLIMITED copies

  • UNLIMITED music videos

  • Radio Broadcasting rights (UNLIMITED)

Resale of the beat or any modified versions of it is not permitted. The customer is allowed to alter the beat and adapt it to their musical preferences.

3.4 Publishing Rights and Composer Credit

The customer has the right to publish and monetize (commercially exploit) the song created with the beat according to the purchased license. However, the producer of the beat must be informed before publication. The producer must be credited by name in the publication. Additionally, the producer must be registered as the composer with 100% credit under his legal name "Tobias Popp" when registering the song with performance rights organizations.

3.5 Delivery and Stems

The purchased beat will be provided to the customer without tags as WAVE and MP3 files. Stems will only be provided after prior agreement and are not included in the purchase price.

 

 

4. Disclaimer of Liability

 

4.1 Liability for Content
The content of this website is created with the greatest care. However, the operator assumes no liability for the accuracy, completeness, or timeliness of the content provided.

 

4.2 Liability for External Links
This website contains links to external third-party websites over whose content the operator has no control. The respective provider or operator is always responsible for the content of the linked pages.

 

 

5. Right of Withdrawal and Return
As the services and products offered are digital and tailored to the customer’s individual requirements, there is no right of withdrawal. Returns are excluded.

 

 

6. Final Provisions

 

6.1 Changes to the T&C
The operator reserves the right to change these T&C at any time without providing reasons. The changed conditions will be communicated to the customer in due time via email or on the next visit to the website.

 

6.2 Jurisdiction
The law of the Federal Republic of Germany applies. The place of jurisdiction is the operator's registered office if the customer is a merchant, a legal entity under public law, or a special fund under public law.
